Built 2 Recover, LLC (“B2R”) provides this Privacy Policy to establish your trust that any personal information you share with B2R will be protected, and its use limited. By providing B2R with personally identifying information, you are consenting to the terms of this Privacy Policy. Please read it carefully. Collection of Personal Information, Including Consumer Health Data

The mission of B2R is to provide you with access to meaningful exercise videos and related products. To achieve that mission, B2R collects personal information from you to provide you with the best possible service. B2R does not market or sell your personal information to third parties, nor does B2R market or sell your Consumer Health Data to third parties.

B2R collects PII and Consumer Health Data for its own use, through registration for our services, orders for specified products, or answer to questions designed to tailor your experience on the site. For example, when you sign up for services, we will ask for contact and payment information. Information that you may be expected to provide when signing up for services includes:

  • Name
  • Address
  • Telephone number
  • Email address
  • Credit card or other payment information
  • Demographic information

Further, to tailor your experience on the website, B2R may ask for your Consumer Health Data, such as height, weight, physical condition, and fitness goals.

B2R may automatically collect information about your computer hardware and software. This information might be stored in cookies or log files and might include:

How Your Personal Information is Used

B2R strongly believes in using personal information only as necessary to provide you with the best possible user experience. We only use personal information to conduct, facilitate or in furtherance of a transaction. For example, we use personal information to charge a credit card for services. We will also send transactional notices to a purchaser and any gift recipient(s), including reminders that a service or gift certificate has not yet been redeemed.

We may share your personal information with our trusted partners, or “data processors”, to help facilitate payments, make deliveries, or provide client support. Any third parties with whom we share your personally identifying information are prohibited by contract from using your personal information for any purpose other than to provide these services to us or to you on our behalf, and such third parties are required by contract to maintain the confidentiality of your personally identifying information.

If you “opt in” by registering for services or purchasing a specific product, we may use your personally identifiable information to inform you of other products or services available from us or companies that we affiliate with. We will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal processes; (b) protect and defend B2R’s rights under the law; and (c) act under exigent circumstances to protect the personal safety of our other users, our clients, or the general public.

We may aggregate limited demographic information, purchasing behaviors or web traffic patterns. This information will not be tied or traceable to any personal information.

How Your Personal Information is Protected

We protect your personal information both online and offline. Online, account information is protected by industry standard methods of encryption. All credit card information is encoded and protected using multiple layers of network security, including firewall protection. Offline, personal information is also protected in our offices by both technological means (e.g., data encryption) and policy procedures. Access to personal information is restricted to people properly trained to handle it and limited in use to what is necessary to perform a specific task.

Any person tasked with handling personal information is informed of any changes to this Privacy Policy and corresponding requirements, and we have processes for handling security breaches.

Your Rights to Control Personal Information

The General Data Protection Regulation (GDPR) provides rights to citizens and residents of the European Union (EU) to control their data. B2R has chosen to extend those rights to all users and clients, regardless of citizenship or residence. Under this Privacy Policy, you have the right to:

  1. Data Breach Notification. We will inform you and the relevant legal authorities within seventy-two (72) hours after we are made aware of a data breach that includes your personal information.
  1. Right to Access and Data Portability. You have the right to ask us what data we have collected about you, with whom we have shared or may share that data, where your data is being stored, and for what purpose we have collected and are using that data. Many of the answers to those questions can already be found in this Privacy Policy. You may also request a digital copy of any personal information we have collected from you, and you may request that we send such a copy to another party of your choosing.
  1. Right to be Forgotten. You may request that we stop using the personal information we collect from you, stop transmitting it to third-party data processors, and erase it from our records and databases. In most cases, we will simply grant this request. In some limited circumstances, such as when we are contractually required to provide services to you and need the personal information we have collected to do so, we may delay granting your request until such time as it is feasible for us to stop using your personal information and erase it. We may also deny your request if your personal information is the subject of a valid law enforcement request or preservation and/or disclosure of your personal information is required by law or by order of a court of law.

State-Specific Rights (Not California)

The states of Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia provide their residents with certain rights, including the following:

  • Right to access data, including obtaining a copy of the personal data B2R holds about you.
  • Right to information about third parties with whom we share personal information.
  • Right to correct inaccurate personal information.
  • Right to delete personal information upon request.
  • Right to opt out of sale of your personal data.
  • Right to opt out of use of your personal data for targeted advertising

If you are a resident of Colorado, Connecticut, Montana, Oregon, Texas, or Virginia, you may contact us to appeal the collection, storage, and use of your personal information.

Rights granted by states have been changing frequently, and B2R will update this Privacy Policy as such changes occur.

State-Specific Rights (California)

This section applies only to residents of California, as required by the California Consumer Privacy Act of 2018 (“CCPA”), the California Privacy Rights Act of 2020, and any related regulations.

California consumers have the right to request: (1) that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the categories and specific pieces of Personal Information we have collected about you (“Right to Know“); (2) that we delete the Personal Information we collect about you (“Right to Delete“); (3) that we correct inaccurate Personal Information we hold about you (“Right to Correct”); (4) to opt-out of the sharing of your Personal Information and Sensitive Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising) (“Right to Opt-Out of Sharing”); (5) to opt-out from the sale of their Personal Information and Sensitive Personal Information (“Right to Opt-Out of Sale”); and (6) that we limit the use or disclosure of your sensitive personal information to purposes set forth in the statute, including that use which is necessary and anticipated to perform the Services or provide the goods reasonably expected by an average consumer who requests those goods or Services (“Right to Limit The Use and Disclosure of Sensitive Personal Information”), all subject to the meanings and exceptions set forth in the CCPA.

If you are a California Consumer and would like to exercise your rights, please email your request to us at [email protected], stating your specific request. If you make a request, you must provide enough information to allow us to verify you are the person about whom we collected personal information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate, and respond to it. We can’t respond to your request if we can’t verify your identity. Making such a request does not require you to create an account with us, and we will only use the information you provide in a request to verify your identity. If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request. Pursuant to the CCPA, we will not require you to verify your identity, beyond asking for the information necessary to complete your request, when you exercise your Right to Opt-Out of Sharing or Right to Opt-Out of Sale.

If you are an authorized agent submitting a request on a user’s behalf, please complete the applicable request as per the instructions below. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request and must be clear about the permission granted.

Alternatively, you as authorized agent may submit a power of attorney document under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own as an authorized agent, must be verified to fulfill your request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

Changes to this Statement

We will occasionally update this Privacy Policy based on user feedback and changes to the legal and regulatory requirements imposed on us. While we try to inform our users when we make changes to this Privacy Policy, we encourage you to regularly review it.
